 Drove a 1999 Forester under 35K miles.  Several times the  pedals,...

 Drove a 1999 Forester under 35K miles.  Several times the  pedals, brake and accelerator, were activated at the same time, never in a critical situation and correctable with foot adjustment without an accident.  Now, an accident where my foot was caught between the pedals, with my foot trapped under the brake, couldn't stop at an intersection, car proceeded across and hit a pickup head-on, stopped at a stop sign on the  the opposite side of the street, totaling the Forester, and putting my husband in the hospital for 10 weeks with rib fractures with complications, and a compression-fractured leg; and me the driver for 2 days and as an outpatient for numerous follow-ups for rib fractures, and ankle crack.  I have a picture, taken by an attending Policeman, of my shoe still wedged in that position.  No interference from floor mats, etc.
Having been driving about 15-to 20 mph, travelling between 2 STOP streets, all this took possibly one minute, hardly time to evaluate the situation and take evasive action.

Yes the dealer can check fuel volume, the tech just has to do it and apparently didn't.
