I recently had a collision in my 2004 Mazda Tribute. I was stopped in a line of traffic at a red light. Suddenly, my engine revved and my car lunged forward, rear-ending the car in front of me. My air bags deployed and I sustained significant injuries. After investigating this online I found the NHSTC recall number 04V583000. Recall states:
Summary: On certain sport utility vehicles, the accelerator cable may prevent the throttle from returning to the idle position.
Consequence: An unexpected increase in engine idle speed may increase stopping distance and may result in a vehicle crash.
Remedy:
Dealers will replace the accelerator cable. The recall began on january
28, 2005. Owners should contact mazda at 1-800-222-5500, option #4.
Unfortunately, I purchased the car used in 2009. I don't know if I would have any recourse through Mazda or through my insurance since the car wasn't purchased through a dealer.
Does anyone know if Mazda or the dealer would be responsible for not fixing this problem before re-selling the car?
